Maybe I am wrong but if anyone voluntarily walks/comes onto my property then I can take photo's of them and use them no problem. No one forced him to come on. Justin Bieber(the real one, not Justin Snaith!:D) walks into my house, I will or can take and use photo's of him. Don't come there if you don't want me to take the photo. Easy. Have there been any cases where the operators have enforced this rule?

Craig, i don't think you give up all your personal rights, or even give anyone permission to do anything just because you are in their domain. Can your bank make a really cool advert using that image of you picking your nose while you were in the queue the other day?

I see what you saying JD and they probably could use it as I am on their property but would not like it.There is a rule in place as we see above so I expect they can do what they want but unless you were going to use it commercially I don't think the rule would be enforced.

I don't think there has been a case where these have had to be enforced locally. There was a case in the UK not too long ago where a large chain story printed a pic of Rihanna on a t-shirt and it sold millions - Rihanna sued and had the items removed from the market . The issue was that had the picture been taken of her publically performing it would be ok, but the said picture was taken of her shooting a video which had still to be released (if anyone knows the exact details of this case, please correct me if I am wrong).

Not that any horse here is as famous as Rihanna, and not that anyone is going to print millions of t-shirts with RED RAY on it and cause a market storm and infringe Red Ray's rights on image copyright. Right now, these clauses (along with some H&S issues) are being considered, as I understand, as a reason why the press is being hindered from taking photographs. AS IF there are 500 tabloid photographers clammering for a position at the finish line to take pics...if only! It would be nice if thousands took pics of racing and some of it made its way freely and consistently on to Facebook, Twitter and the like, as well as into magazines, tabloids. All of this would help the cause of getting racing into the social awareness as a sport.

Just thinking, many trainers(including me) use images from GC's site for our own facebook page and or websites and they have never complained or even said a word to us. (tu)
