Whenever the operator 'opens its mouth' I am soooooo grateful that I am not, in any way, dependent upon the horse racing industry for anything other than occasional, mediocre and very expensive entertainment.
The Legal/PR department, in particular, seems to have an impressively ineffective record when it comes to making windy, anonymous statements chiding whichever poor soul has been brave enough to criticise them.
Robyn Louw's latest article certainly got a few of their number 'hot under the collar'. But not hot enough to actually put their names to the rebuttal issued.......
Yet something in their response niggled.........so I looked up the definition of 'slander'. Here's what two authoritative sources have to say :
Oxford Dictionary :
"The action or crime of making a false spoken statement damaging to a person's reputation".
Legal dictionary :
Slander. n. "Oral defamation, in which someone tells one or more persons an untruth about another, which untruth will harm the reputation of the person defamed".
Both sources (and there are plenty of others!) are in accord on one issue - 'slander' needs to be SPOKEN to constitute slander. Ms Louw's article was written.
Well done operator! Give that department another bonus and an additional tranche of shares.

Garrick, firstly they would have to establish that their reputation could actually be tarnished further, maybe a poll on their current reputation could establish if "slander" was even possible.

Same reason why the Zuptas could not sue Jacques Paauw, AmaBungane, etc. It has to be an untruth.

Bullies are actually cowards, with something to hide.
