Death of Rock Stewart

Is a two week suspension of a jockey directly responsible for the unnecessary death of a horse a fair and just punishment? We have all seen far greater sanctions imposed for 'pulling up' a horse (at least the horse lives to see another day) or seen big fines imposed for far less offenses.

I am personally shocked and appalled!

Even though the jockey might not have meant for this to happen, the principle of dolus eventualis applies. Intent in the form of dolus eventualis or legal intention, which is present when the perpetrator objectively foresees the possibility of his act causing death and persists regardless of the consequences, suffices to find someone guilty.

If Richard Fourie had been killed (and thank God that he wasn't!) Corne Orffer would be charged with murder and in all probability would go to jail, and yet the value of a horses life is so inconsequential in the sport of horse racing that a two week suspension (during which time Orffer can languish at the beach if he wants) is seen as a fit, fair and just imposition.

I strongly disagree! The life of a horse is far greater than a two week stint on Camps Bay beach!

The minimum should have been a large fine imposed and paid to the owners as recompense for his deed and a much, much longer suspension. 2 weeks worth of pay to Orffer is a laughable punishment when compared to the potential loss of 10's or even 100's of thousands of future earnings that the owners of this horse have lost. And as for the heart sore they are no doubt suffering, no amount of money will cure that. The horse is dead. What a terrible, terrible shame!

My sincerest commiserations go to the connections of this horse. What has happened to them is so incredibly unnecessary and very, very sad. And as for the loss of this promising horse, one is without words. Albeit a tiny consolation, (as someone pointed out on the Durbanville thread) apparently she died instantaneously and hopefully didn't have too suffer.

Jocks get the same for hitting a horse with the whip wrongly... pretty lenient

I gather the jock kept riding horse when it was injured?

She was cut into and as a result Fourie nearly when into the rail. Clipped heals and fell. Breaking her neck. She wasn't injured, as I understand it. Jockey has admitted his 'mistake'.

Jockey C Orffer (BUTTERFLY SPIRIT) was charged with a contravention of Rule 62.2.7 in that he failed to ensure that he did not cause interference to ROCK STEWART at about the 200m. Jockey C Orffer signed an admission of guilt and was suspended from riding in races for a period of 14 days. (w.e.f 16/10/2016 to 29/10/2016 both days inclusive)

What I would like to know is if Corne has contacted the owners and apologised ? What happened was totally unintentional but I have to agree the punishment seems way to lenient for the offence.

Rock Steward had potential and was a good horse in my opinion.

Would the punishment had been any different if C. Orffer cut into a Legal Eagle / Abashiri / a Dubai bound MDK horse rather than a maiden from a small stable???
