this is the darkest hour for south African horseracing ..the fact that this trainer never got a life ban means the nhra are gutless toothless and totally fucking useless ..

One thing that seems strange is that if you want to improve a horse,say 5 lengths ,why not just manipulate the MR down by 10 points - the regulators have no test for that nor is the "run on merit" or "consistency" rule enforced - same result, no sanction!!!!!!!!

So based on the judgement in my opinion the NHA was killed by procedure.
This is sad considering what was found at the yard and the results from the blood tests but the law and justice seldom meet at the same point.
I really implore the NHA to revise their SOP's and their general procedures in order to limit counter legal action.
I state for the record that any horse in training that tests positive for testosterone should lead to the trainer being warned off for life.
The NHA should immediately implement new conditions to holding a trainers license including paying the damages to owners automatically when horses tests positive for testosterone.

Have had a message asking if the big fines instead of bans are anything to do with shortfalls in Nhra funding ?

On procedure alone this case could have taken another two years. The cost of an advocate would start at 50k a day for a court appearance so my opinion is yes without funding a fine was the most logical route.
There should be a percentage allocation of turnover to the NHA, they should be independent and most importantly get started immediately on a new set of rules and conditions. Exactly what is happening with the Public Protector at the moment, you cannot prosecute without a bank roll.
In all doping cases so far the legal challenges have not been exhausted as you have not had a punter and or bookie take any of these trainers on. Once a trainer has been fined for the use of performance enhancing drugs in a race there is definitely enough reason for civil action with regard to loss of money by bets placed.
There is scope to make it a criminal act based on the amount of money bet in the races that these horses contest.

U not wrong at all Tigershark. Only problem is that NHA prosecute in terms of their rules. So if a syringe containing traces of a prohibited substance is found on your stables, you are guilty. If your horse is positive, you are guilty....no need to prove that you had anything to do with it.
Kobus Roux was warned off without having been to his satellite yard for weeks before...
So now how does the Punter or the Bookie prove, in a court of law, that the Trainer actually doped the horse or that he arranged it or had knowlege of it ?
As per my post on the thread Sportingpost, we Trainers had better wake up and secure our yards....because either way, we will be guilty....

Possession is 9 10ths of the law. I guess the onus us the horses stakeholders to ensure their horses are clean. How else would you drive accountability. Something that this game is crying out for on a regular basis.
