this is a shocking story. A real train smash.

I'm just surprised the owners involved never asked for proof that the money was paid over to SARS. After all they are a government branch.....

I'm certainly not pointing any fingers as I understand you were acting in good faith and at the time had no reason to doubt this man......still, especially in SA you would want proof of all transactions, especially where an agency known for neglect and misplacement such as SARS is involved.....

Hope this works out.......Anybody want to open a bloodstock shipping company with me?

What this does is throw a spotlight on the horse racing as a whole - perhaps a mass audit of all facets of racing is required. The open bet may not be the only drain on this industry and hidden behind veils is more dodgy dealings.

The "turning states witness" portion of the report may reveal further interesting facts. I am sure that there are some very nervous people in racing and perhaps even in SARS or government at the moment. In my opinion we should look for sudden change in racing activities and the truth may be revealed before it even reaches a court room. Turning states witness suggests that this issue is far bigger than what meets the eye and suggests that the alleged culprit has not acted alone. Why would the state offer such a deal if there were not bigger fish to fry.

Anyway its sad that the industry will recieve more bad publicity but a thorough clean up of racing in general is probably long overdue.

this story will blow over and mr roux will be welcomed back into the racing industry just like all other individuals that have been caught for fraud ,bribery and corruption and irregular betting activities...just look around at some of the seedy people in the game with these backgrounds...

I feel very sorry for the victims of this scam - no matter how wealthy they are. Or not.

Imagine - you transact business with this guy. You pay your bill inclusive of VAT. You legitimately claim back your VAT - either through your own registration or through a VAT recovery agent ( and there are a number of them offering their services on a multitude of racing sites and publications ). Then you spend the VAT recovery.........

Suddenly - years later - you discover the slimeball has dropped you in it big time. Ugh. Now here's the thing : Have any of us EVER bothered to check whether our VAT transactions have been correctly handled? Of course not. And even if we wanted to - how would one do it?

What would happen if - for example - Bloodstock South Africa decided to play ducks and drakes with VAT paid at the National Yearling Sale? The mind boggles.

I'm just disgusted at the 'deal' brokered. I hope all the victims pursue the transgressor in the civil courts.

This raises an interesting thought(I have no knowledge,I am just thinking aloud)
If your local shop,electrician,plumber etc etc does not pay over your vat payments,there is no recourse against you.Is that cos they have been registered and authorised,as an agent,to collect on behalf of SARS ?
Why is BBR different? ......or were they not vendors and therefore collecting without such authorisation,and therefore illegally?

The difference with a shop is that the shop owns stock and customs and excise has been paid on imported goods at some point in the buying and selling chain. As I understand it the shipper offers to pay customs and excise (SARS) on your behalf. Remember the shipper was never the owner of the bloodstock being shipped and the owner is ultimately responsible for import duties to SARS.
