AN appeal lodged by trainer Geoff Woodruff and part-owner Derek Brugman against the Merit Rating of the Summer Cup entry Aluminium (MR 103), has been dismissed on a technicality.

The appeal was lodged as a result of the earlier decision of an independent panel which resulted in a downward adjustment to the Merit Rating of other Summer Cip entries Smart Banker and Rudra after the running of the Victory Moon Stakes.

The appeal panel decided that it was not able to hear this appeal by reason of the fact that the connections of Aluminium did not qualify to lodge an Appeal in terms of Rule 54.16.1 which provides that appeals must be lodged within three days of any Merit Rating Adjustment being published. As no Appeal had been lodged against Aluminium's Merit Rating which was last adjusted after he raced on 20 July 2008, the matter could not be heard.

THE panel consisting of Messrs K Miedema, G Hawkins, R Napier, M Lips and C Aitken was convened on Tuesday 18 November 2008.
