R50000 fine for the use of the K-word

Trainer Botha allegedly used the K word when having a go at the Vaal track manager.
I think the NHA got this spot on.

So did he have to pay the fine or was that suspended as long as his license? I never found that clear on the notice. If he used that word and it became knowledge i`m sure racing would come under even more pressure for not taking away his license

I'm going to play the devils advocate role now. Obviously Botha deserves censure if the allegations are truthful. I see the problem as follows:
1. The person harmed was the course manager.
2. He is employed by Phumelela and not the NHRA.
3. The R50000 fine is paid to the NHRA while the victim receives nothing. This is untenable. It's as if the NHRA is preying on everyone and hoping that they do something wrong so they can make a quick buck.
4. The victim should lay charges of crimen injuria against Botha and/or proceed against him in civil court for all losses suffered as a result of the impairment of his dignity and reputation.
5. The victim could take Botha to the Human Rights commission and take the issue further regarding hate speech.
IMO the NHRA rules are clearly lacking. If a crime or a civil wrong has been alleged, the victim should be the one that takes criminal and/or civil steps. If a court subsequently finds Botha guilty of a crime, then only should he be charged by the NHRA. The NHRA would then also have the opportunity to take into account the damages awarded to the victim before imposing further sanction.
If the victim chooses to take no further action then the NHRA should leave it well alone. The NHRA should not be used as a tool to extract revenge and as a tool to fine the offender to improve their finances.
Let's reflect on the actions taken against Botha and compare them to the actions taken against the PE grooms. It's all about money.

The fool should have been kicked out of racing. The course manager and the NHA should open a case.

Probably opening a can of worms here, but I'll say this and keep quiet on the subject; imo so-called 'hate speech' - against all groups - surely pales in insignificance when compared to crimes like murder - whether the victim is black or white :huh:

Ridiculous statement. It's like saying surely better to be anorexic than obese. Racing has an image to maintain, along with the country. If the country is ever going to move forward from the injustice of the past then all form of racism needs to be obliterated.
It is this type of attitude, almost leniency, by the non-racists, that allow the racists to feel it is okay to be racist. There is a reason a sport as humongous as the premier league takes it seriously enough to not allow it at all - No Room For Racism.
NB. Let me also say, I am purely commenting on the statement I have quoted here, and not reflecting in anyway on you personally.
