Towcester chief among four guilty of corruption

TOWCESTER chief executive Kevin Ackerman was one of four on Wednesday found in breach of involvement in corrupt or fraudulent practices in relation to racing by the BHA.

Ackerman, along with registered owner Kenneth Mackay, former registered owner David Greenwood and jockey Michael Stainton, has been found in breach of rule (A)41.1 - which has an entry point of exclusion from the sport for three years, and a range of six months to ten years.

A fifth member of the investigation, former jockey Claire Murray, was found not in breach of any rules.

Murray said: "I would like to thank my solicitor, Mark Edmondson, and also Paul Struthers of the PJA who represented me in the hearing. This has been a nightmare and I am just pleased that it is all over."

The BHA's disciplinary panel found Greenwood gave Stainton instructions preventing Ad Vitam from achieving its best possible placing in races at Kempton and Wolverhampton between November 2011 and February 2012.

'For handicapping reasons'

A statement said: "David Greenwood's purpose in getting Michael Stainton to ride in this manner was for handicapping reasons: it was done to try to reduce the horse's official rating to a mark at which David Greenwood judged it would be more competitive."

On the acquittal of Murray, the BHA added: "While he [Greenwood] hoped that the horse would run down the field for handicapping reasons, he was seeking to achieve this by using an apprentice [Claire Murray] whom he judged, correctly, to be too weak a rider to produce the horse's best efforts."

Lay bets placed by Ackerman and Mackay

Greenwood communicated these intentions to Ackerman and Mackay without reward. Ackerman then placed lay bets on four occasions, while Mackay did so once.

Stewart-Moore Solicitors, acting on behalf of Ackerman and Greenwood, issued a statement: "We are profoundly shocked by the disciplinary panel's findings in relation to our clients, Kevin Ackerman and David Greenwood. The brief document released by the panel in support of its decision makes very little sense.

"Indeed the reasoning set out therein appears to be fundamentally flawed. It is very hard to fathom, for example, how Mr Ackerman has been found guilty of a corrupt or fraudulent practice in circumstances where the panel has accepted that the BHA failed to establish the central allegation that there was a conspiracy.

"Until the panel has released its reasons for this decision it is not possible for our clients to respond further save to say that there will be an appeal.

"It has taken the panel the best part of two months to provide the cobbled together document it has published today. It is to be hoped that its members will now get their act together and publish their written reasons without further delay in order that the appeal process can begin."

PJA: 'We do not understand the findings'

Struthers, chief executive of the Professional Jockeys Association, said: "We do not understand the findings or on what basis they can have been reached or why, nine weeks to the day after the substantive hearing concluded, a confusing two page summary is all that's been handed down.

"Given the confusing nature of the findings, it is difficult to know what this means for Michael Stainton but we are pleased that Claire Murray has been entirely acquitted, albeit only after a nine-week wait. It is our view that she should never have faced charges.

"It will be interesting to read how the disciplinary panel justify their findings and if there is any substantial penalty for Michael he will definitely appeal, although financial constraints are likely to be a major issue. Until such time as those reasons are published, there is little more to say."
