Maybe one ( or some of the clanners ) who has a legal background can answer this....
-Who sets the minimum sentencing parameters in SA ?
-Why aren't these minimums being raised substantially to, in effect, deter crime ? In this case I'm thinking specifically about any form of rape and police killings ( as in police officers killed in the line of duty ). I am a firm believer that minimum sentencing without the possibility of parole is the first step ( of many ) in combating crime. Once criminals know that there will be no 'alleged', no 'extenuating circumstances', no 'early release' , etc then they will start to worry. You would think twice about raping someone if you knew you faced life in prison without parole whatever the circumstances.
-Also, a review of our so called judges/magistrates is high on a list of priorities. Any judge/magistrate who releases a person accused of a crime on bail should be suspended without pay should this person reoffend whilst out on bail.
-Is there any truth in the story that judges get a salary for life ? If so, where can I apply for this most wonderful job ?
-Courts should work longer hours !
-Police labs should be brought up to internationally accepted standards so that evidence produced in court is fool proof and produced in a reasonable of time.
-Also any person convicted of rape of a young person/child should not be allowed out of prison until the victim is much older. I find it odd that a person can rape a child yet be released when this child is now a teenager ( talk about a get-outta-jail gift ).
-Other things to look at, especially if the offender has the funds, is for financial compensation. If a rapist who owns property rapes then the property is sold and all proceeds go to the victim tax free.
-Furthermore we need a sex offenders register set up. I want to know when a rapist has been released from jail and has moved in up the road from me.
-Lastly, could we please move away from this human rights b s. Yes, we need rights but of a political kind to prevent our country from returning to the past but rapists and their ilk should have no rights whatsoever once found guilty.
But having said all this and hurt my keyboard in the process I have just remembered that we have one of the weakest governments on the planet who are perfect at talking but not performing. Cry the beloved country...
