A simple explanation of our justice system's workings please...
13 years 4 hours ago
I hate to bring up non racing and sporting activities on this forum but I feel that this is the only place where I can get some sort of explanation for an important subject...
Here goes :
Why is something concrete not being done to reduce our high crime levels ? I address this question more to the judiciary than to the police or civilian crime fighting organisations.
Why has minimum sentencing not been introduced and why are extenuating circumstances still being taken into account at sentencing time ? If the powers that be are so keen on reducing police murders and rapes for example shouldn't the perpetrators be made aware that if they do such a crime they will be put away for a predetermined period. In the USA police killers get a minimum of life in jail. As for the extenuating circumstances bit, why is it okay to say that the perpetrator was on drugs or drunk when he raped a young child ? Rape is rape is rape !
Who sets the sentencing guidelines for crimes and why has this person or organisation not been brought to book for their poor record ? One day you can read about a murderer getting a stiff sentence yet the next day another murderer gets the proverbial slap on the wrist.
Should judges performances not be reviewed on a regular basis and their perks or salaries adjusted accordingly. I recently heard that a judge has a salary for life, cushy number if you ask me. In my industry, if I cock up I get the book thrown at me and my chances of promotion or a higher salary fade away a bit whereas in the judicial system if a judge gives a known criminal bail and he goes out and commits a crime again the next day it seems perfectly normal. Surely one of the reasons the criminal acted again is because he was allowed to walk out of jail by a judge. That judge should then have the riot act read to him.
Why is a person accused of a crime allowed to apply for bail and then, if it's refused, to appeal the decision and apply for bail again and again until he gets to walk out of jail ? The appeals clog up the courts and surely the first judge's decision should be final. A second judge granting bail after the first has refused is purely and simply undermining the first judge's work and questionning his aptitude.
Why do some cases drag on for years ? The Jub Jub trial is a good example. In the UK you can be found guilty or not on a Monday and be sentenced on a Wednesday and have your request for appeal turned down on Friday, so to speak. In our country the same process takes months, if that...
Why do some people found guilty of a crime have recourse to umpteen appeal processes ? They are clogging up the courts and obviously using their money and influence to avoid the inescapable. Sifiso Zulu is the best example of this.
I know that our police force are often pilloried for their performance ( sometimes rightly so ) but it must be widely acknowledged that they are but one link in the system and maybe it's time for our judges to start earning some of that big money they get...and in their case they are getting it for life...

If you want an interesting angle on your question read a book written by Antony Altbeker called "A country at war with itself" which explores the very question you pose!

Rob, keep the pekker up. Good always advances over evil.
You Brits never educated the some of the locals long enough to instill any form of common sense into them.
One plus one does not equal two in Africa. Pity the downtrodden and keep the flag flying.... you all they got...

To Avanza, holy sh.t, you called me Dear Sir....makes me feel important (
) Just to put you in the picture, I'm actually a Saffer not a Brit, who lives outside Durbs and I just get the sh.ts at seeing my beautiful country and it's great people being held to ransom by a bunch of no-gooders who hide behind what is a called a justice system. That's a big bee in my bonnet...

Sorry... but if you a safer from Durbs then you are of Brit extract
I am Italian extract..
As mentioned on this forum before, and rightly so, do not let the political incompetency worm too far into your head, it will kill you or at minimum make you grey.
Those no gooders you reference must be tackled head on. Look at the etoll lobby, Afriforum (don't let people fool you they right wing, they were the ONLY ones that had the balls to take fat kid to court.. support them), ....
The moral of the story of above victories is... stand together... all GOOD people of SA...do not let race creed or history divide the enemies of injustice. And be willing to sacrifice and support each other.
Look at the ethnic people of Zimbabwe.. they have been murdered and dissapeared enmasse.. makes the apartheid regime look like child's play... this is a spiritual war, good over evil.
Evil prospers where good men do nothing.

Well said Avanza, except the 'insulting'(
) bit about me being of Brit extract...I am not...
If we all stood up and were really counted it would make a huge difference...

If this is true, why do we support Zim racing?? surely like sanctioned where put on South Africa during the apartheid era and we were banned from playing international sport then we should NOT be supporting anything to do with Zimbabwe?? ... Just asking...

then in the same breath why do you support UK racing. A country that had an illegal war in Iraq where over a million innocent people are no longer with us? Also just asking.

Cause people will sell their mothers for the dollar... and this government lies when it says it stands for human rights... they stand for anything that fits their agenda..

What is better future for the world.. Thatcher or Saddam? I will go with Thatcher...
Without trying to oversimplify a very complex part of the world I.e. middle east. Those million lives can just as easily be attributed to al queda and partners... who started the war... if your affiliation is muslim for example you might side with the anti Brit stance... fair enough.. but if you try and lay the blame with the Brits solely ... well then you are simply and plainly brain washed.
