Trainer James Goodman NHA Review application fails

The National Horseracing Authority has confirmed that a review application by Trainer Mr J M Goodman to set aside the decision of an Inquiry Board was heard in the KwaZulu-Natal High Court, Durban, on 15 March 2013.
The Background
At an Inquiry which was concluded on 20 August 2011, an Inquiry Board, chaired by Adv. G I Hoffman SC, found Trainer Goodman guilty of a contravention of Rule 73.2.4 in that he was the trainer responsible for the horse SEVEN NETWORK at the time when a specimen taken from his horse after it participated in Race 6 at Scottville Racecourse on 7 November 2010, disclosed upon analysis the presence of Diclofenac which is a prohibited substance in terms of the rules of the NHA.
The Inquiry Board imposed a fine of R65 000 on Trainer Goodman.
Furthermore, the Inquiry Board declared SEVEN NETWORK disqualified from the race in question and the provisions of Rule 67.7.8 shall apply.
In the judgment handed down on 5 April 2013, Trainer Goodman’s application was dismissed with costs.

I don't know all the facts....or any of the facts.....but what irks me....
An anti-inflammatory that a lot of people use every day...does it turn my aunt Agatha into Usain Bolt? not by a long fark.....
It enables her to go shopping.....
in short....I think medicines have a role to play....
Is the R65k harsh....IMO yes....
How much must the owner pay in vets fees every day to see if the urine sample is clear....

Diclofenac is another name for Voltaren which is an anti-inflammatory I think.
Does it may the horse run faster by relieving pain?

Would not make the horse run faster, but should you be racing a horse that has an injury requiring an anti inflammatory?
Lost with cost- any fee (legal etc) incurred by the person opposing the ruling is to be paid by said person.
Jockey club is not liable

of course it makes a horse run - if i have a crook joint i apply an anti inflammatory cream or have an injection now i can do some exercise with less pain than i could before if i choose to - i would be able to do less without it's aid . I have an old dog and she sometimes seizes up and battles to walk and after an anti inflammatory injection she becomes mobile therefore she moves"faster" than she could without the injection!!

These are the facts and the reasons why I took the N.H.A on review in the high court.
Seven network returned positive for Voltaren. He always had a stiff back and I rubbed him down with Voltaren gel every day.Most athletes get this type of treatment before their events.
The NHA found me positive at a reading of 105 ml per ul. The USA only call a positive for Voltaren at 500 ml per ul. The NHA have decided arbitrarily that the positive will be called at 50 ml per ul. This was confirmed in the enquiry. They had not confirmed this level with any other racing jurisdiction,this was also confirmed at the enquiry. In effect this is the same as the police fining you for speeding without any speed restriction warnings in place .
When the enquiry started my legal representative asked whether the NHA intended charging me and this they confirmed and asked me to plead to which I pleaded not guilty .from that decision the NHA had to prove their case which we believed they did not. The head of the lab gave all the evidence although he never handled the sample. This in itself gave us the confidence to go to court as all the evidence was here say .There are a number of other issues which we were unhappy about and we are considering an appeal.

it seem to me that the jockey club is lacking for one very important thing. this thing is very difficult to have when you think that you are the prosecuter the judge and the jury. this thing i talk about is called common sense. gamotto 65000 rand fine for the gel? this is crazy and show how stupid they are. i ask question only. what they fine james if he use a anobolic steroid, 5 million? if this one of big 5 trainers do they get the same treatment? i dont think so!

Why was the fine so high?I don't know the history but normally the fine goes up if you have priors - Not sure if Mr Goodman does or not - First offence is normally lower as far as i remember

Absolutely right flash. Anabolic steroids are allowed by the NHA under a certain limit .they are performance enhancers. Voltaren at 20% of the USA limit .???

james i just think of this. being ignorant of the law is no excuse that we all now. but in this case not having the clear law is the different thing totally. i am not the lawyer but really im sure if what you say is right a court cannot find you guilty for be so much lower than the usa rule? as the matter of interest do the uk or france or hong kong have levels they prosecute at? i say again it look to me like you get punish. what i will say if common sense prevale is this - the jockey club give you warning be cause the readings are there. THEN THEY CHANGE THE RULE SO EVERYONE IS NOW THE LEVEL. that is fair to all. so you now when you rub the gel you have may be a problem. this seems like you get victimise now every one who dont now the story think you have long needles. its very unfair
