Striker Mario Balotelli will face Manchester City at a Premier League tribunal on Wednesday.
The controversial Italian has decided to appeal City's decision to fine him two weeks' wages for his poor disciplinary record in the 2011-12 season.
City initially took the action in April after the Italy international was dismissed in the 1-0 defeat against Arsenal at the Emirates Stadium.
Balotelli chose to appeal the punishment but the penalty was upheld by a panel made up of City board members. A fine of two weeks' wages is the maximum a club can hand out.
Now, the 22-year-old will face a Premier League panel. Reports indicate he will be joined by his Italian lawyer and a representative from the Professional Footballers' Association, while City will be represented by their legal team.
"We try to avoid situations like this wherever possible, but the player and club have not been able to resolve this situation," PFA chief executive Gordon Taylor told the BBC.
Balotelli was sent off three times last season - once retrospectively - and received an additional nine yellow cards. He missed 11 matches through suspension.
After being substituted in the 3-2 defeat against Manchester United, Balotelli was left out of Roberto Mancini's matchday squad for the game against Newcastle United on Saturday.
Mancini admitted that he had omitted the forward for his poor form and urged him to improve his training levels in order to return to the starting XI.
"At this moment, Mario is not in good form and for this reason he is at home," the manager said.
"It is only for this reason. To get back into the team he needs to work in training and when he plays, he needs to play well."

You have no idea what you talking about CNC (as usual), Keane was a leader, he had the respect of players and management ....Balotelli is uncontrollable ... City would walk the premier league if this guy didn't play for them, he is a disruption to the team imo.

I dont hate man u i just dispise their fans. When it comes to football I would say that on this forum I am the most knowledgable. City won the Premier League last season and and will again this season with or without him. He is a 21 year old kid who is famous and has millions let him be.

I actually couldn't care a shit if he wraps his porsche around a tree etc etc... Just thought the article above was interesting, not often an employee takes the ''hand that feeds them'' to court while you still employed by that organisation...

he was fined 340k thats excessive even by premier league wages standards. If you think about it he has been sent off on his reputation. Remember how many times Viera got sent off for nothing? He is dirty but he unlike plenty of players in the league is not a cheat and in a few cases not a racist. They are treating him as if he were a criminal. As his T shirt stated when he glided in the first of 6 against United "why always me"

going back to your line that said that Fergie would have got rid of him long ago. I dont think so. Does Cantona at Crystal Palace ring any bells or Ferdinand missing a drug test and been banned for 9 months? Both guilty, both carried on playing for United.
