100% Naresh. - It's this type of misleading advertising why the Consumer Protection Act was promulgated.
"advertisement"
means any direct or indirect visual or oral communication transmitted by any medium, or any representation or reference written, inscribed, recorded, encoded upon or embedded within any medium, by means of which a person seeks to-
a) bring to the attention of all or part of the public-
i) the existence or identity of a supplier; or
ii) the existence, nature, availability, properties, advantages or uses of any goods or services that are available for supply, or the conditions on, or prices at which any goods or services are available for supply;
b) promote the supply of any goods or services; or
c) promote any cause;
promote
means to-
a) advertise, display or offer to supply any goods or services in the ordinary course or business, to all or part of the public for consideration;
b) make any representation in the ordinary course of business that could reasonably be inferred as expressing a willingness to supply any goods or services for consideration; or
c) engage in any other conduct in the ordinary course of business that may reasonably be construed to be an inducement or attempted inducement to a person to engage in a transaction;
Consumer Protection Act, 2008 (Act No. 68 of 2008)
Chapter 2 : Fundamental Consumer Rights
Part E : Right to fair and responsible marketing
29. General standards for marketing of goods or services
A producer, importer, distributor, retailer or service provider must not market any goods or services—
a) in a manner that is reasonably likely to imply a false or misleading representation concerning those goods or services, as contemplated in section 41; or
b) in a manner that is misleading, fraudulent or deceptive in any way, including in respect of—
i) the nature, properties, advantages or uses of the goods or services;
ii) the manner in or conditions on which those goods or services may be supplied;
iii) the price at which the goods may be supplied, or the existence of, or relationship of the price to, any previous price or competitor’s price for comparable or similar goods or services;
iv) the sponsoring of any event; or
v) any other material aspect of the goods or services
What do you think - I think we as punters have a case here. It's such a pity that we have no representation as punters to take these clowns on

Are they still running the ad? have they posted a "sorry"?
You might be right AL, I normally find we have enough clout these days to get a reply but as far as official representation? another story.

I have not seen the ad, but if it is still being flighted I would not be suprised. They often advertise races long after they have come and gone Racing is clearly a part time hobby. Share price is the core of this business, everything else is irrelevant can be left to the hobbyists. I suggest that GC merges as quickly as possible for the benefit of racing in SA!

Another quick comment before this thread dissapears into web page heaven. I believe that it would be pretty easy even for an individual to take this to the consumer commission but we know that the results of any fine or penalty will have the effect of putting racing into even deeper trouble. I beleive that the bulk of us have racings interests at heart and want to see it grow and succeed. We all know that fines and penalties would be punishment but we would be the ones who ultimately pay, through reduced stakes as an owner, or through even slower progress on the product offered to punters.
It is quite simple we want to see progress. We want a superior offering. At the moment we are paying for a low quality product in certain spheres, yet we have nowhere else to go and race with our rand. This is not acceptable. Please read this P and GC - It is important that you listen to you client base. We are not ignorant pool of money, we are the life blood of racing!

Agree with pirates what a load of BS and yet it continues to be flighted. I think its time they pulled the ad on the ATC bet which is now tired and in fact they should just scrap the ATC bet which is a crap bet anyway. Im not holding my breath.

I hear the ATC is growing in popularity, so it's not going anywhere anytime soon.

The ATC is the best thing since slice bread FROM A P POINT OF VIEW; if we had a punter's organisation, they could have flighted ads informing the punters how they are getting robbed by this bet - using the same examples that P continue to stick in our faces.....

I suppose we should not be surprised by the arrogance; the appropriate response imo should have been:
'Thank you for pointing out such an obvious mistake; we apologise for misleading the public, but we have corrected the mistake and have put measures in place to ensure that something like this does not happen again'
At least that would have been courteous:
